ENGLISH VERSION – Terms and Conditions for sales across the EU

Introductory Provisions
These Terms and Conditions (hereinafter referred to as the “Terms”) govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, and the relevant legal regulations of the European Union, the mutual rights and obligations between:

Buyer:
A natural or legal person who concludes a purchase contract with the Seller through the online shop at: www.lavallee.cz
(hereinafter referred to as the “Buyer”)

 

Product and Price Information

Prices listed for individual products are final, including VAT (if applicable) and all related charges.
Prices do not include shipping and payment costs, which are displayed in the shopping cart before the order is sent.

Product information (e.g., dimensions, materials, manufacturing method) is provided for each product. Due to handcrafting, each piece may be unique with minor variations.

 

Conclusion of the Purchase Contract

The Buyer’s order submitted via the e-shop is considered an offer to conclude a purchase contract.
The contract is concluded at the moment the Seller accepts the order, which is confirmed via e-mail.

The Seller reserves the right to refuse the order in justified cases (e.g., technical error, inappropriate design, production capacity overload).

The purchase contract, once concluded, is archived by the Seller in electronic form and is not accessible. The Seller will allow the Buyer to access it upon request.

 

Payment and Delivery Terms

Payment methods:

  • bank transfer
  • online card payment
  • other methods as currently offered

Delivery times:

  • Czech Republic: for regular goods, dispatch usually within 3 working days after payment is received.
  • Custom hand-painted products: production and delivery time is approx. 4 weeks; the exact date will be communicated by e-mail.
  • Delivery to other EU countries: shipments are dispatched no later than 3 working days after payment is received (for regular goods) and delivered within a maximum of 7 working days from dispatch.

Goods are delivered via the carrier chosen by the Buyer in the order.

 

Withdrawal from the Contract

The Buyer – consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason, in accordance with Section 1829 of the Civil Code and Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

Procedure:

  • Notify withdrawal by e-mail to: info@lavallee.cz
  • Return the goods to: Barrandova 409/1a, 143 00 Praha 4 Modřany, Czech Republic, from any EU country (return shipping costs are borne by the Buyer).
  • The money will be refunded within 14 days of receiving the notice of withdrawal, but not before the goods are returned.

Custom-made products:
Pursuant to Section 1837(d) of the Civil Code and Directive 2011/83/EU, withdrawal from the contract is not possible for goods made to the Buyer’s specifications or clearly personalized.

 

Complaints and Warranty (Complaints Procedure)

Warranty period: 24 months from receipt of the goods (in accordance with EU Directive 1999/44/EC), unless otherwise stated.

Complaints can be made:

  • by e-mail to info@lavallee.cz
  • or by sending the goods to: Barrandova 409/1a, 143 00 Praha 4 Modřany, Czech Republic, from any EU country.

The complaint must include:

  • order number
  • description of the defect
  • photographs (if possible)
  • proof of purchase

The complaint will be processed within 30 days from the date of submission.
Possible solutions: repair, replacement, discount, or withdrawal from the contract.

 

Personal Data Protection

The Seller handles the Buyer’s personal data in accordance with the GDPR (Regulation (EU) 2016/679) and Act No. 110/2019 Coll., on the processing of personal data.
Personal data of Buyers from other EU countries is processed in the same way and is not transferred outside the EU/EEA.

Out-of-Court Dispute Resolution

In the event of a dispute between the Seller and the consumer, the consumer may submit a proposal for out-of-court settlement to:

Final Provisions

The Seller is entitled to unilaterally change or amend the Terms and Conditions.
This does not affect the validity of the Terms for contracts concluded before the change.

The current version of the Terms is always available on the e-shop website.
